First
The below conditions are applicable on all transactions with our organisations and for as far as not different has been explicitly agreed upon. These are just the translation of the original conditions in Dutch. Where there occurs a difference in text or legal meaning of any or all of thes conditions, the Dutch version prevales at all times.

Reservations and bookings
Reservations are handled in the order they arrive to us. There is a limited number of places available (max. 20 persons per journey).

Journeys are under the restriction of enough participants and are no sooner definitive as until they are confirmed as such by us. However a reservation is not without engagement, but binds you provided that the journey goes through. A down payment of 10% of the travel sum is due on reservation.

As soon as enough reservations are made for a journey (minimum of ca. 10 persons per journey), and at the latest 30 days before the planned journeys departure date we will inform you whether the journey will definitively go through or not. Should the journey be cancelled, we will immediately refund your down payment. In case the journey does go through, we will confirm this to you in writing, including everything that is included and possible further specifics of the journey or your reservation and other specifically agreed conditions. At that moment the remainder of the travel sum is due and payable. If we have agreed to reserve your ticket, we will do so immediately upon receipt of your payment of the remainder amount. Only after receipt of the full sum are we obliged to deliver our end of the deal. Non payment, not complete payment, late payment or otherwise non compliance on your side of the agreement does not free you of your obligations.

We are entitled to refuse any reservation if we think there are important reasons to do so.

Cancellation
If you want to cancel a reservation you owe us the following fees:
Cancellation 8 weeks or longer before the (planned) departure date: the amount of the down payment (10% of the travel sum);
Cancellation between 8 and 6 weeks before the (planned) departure date: 30% van de reissom;
Cancellation between 6 and 4 weeks before the (planned) departure date: 50% of the travel sum;
Cancellation between 4 and 2 weeks before the (planned) departure date: 75% of the travel sum;
Cancellation between 2 weeks and 1 week before the (planned) departure date: 90% of the travel sum;
Cancellation less than 1 week before, on or after the (planned) departure date: 100% of the travel sum;

Personal data and privacy
You are obliged to all the information, of yourself and of your travel companions if any, that we need to be able to execute the journey. When you make reservation or book on behalf of another or others, you are personally, solely and jointly with that other / those others, responsible for any and all obligations that result from this, not impeding that persons / these persons own responsibility. With regard to us you will be the contact person for that other / those others.

We will be very carful with your personal information and use it for no other purpose than it is given to us. They will only be given to third parties as far as this is necessary for the execution of the agreement or from legal obligation.

Prices
All our prices are inclusive of VAT (where applicable) and per person. Our prices are based upon prices, taxes, levies, charges, exchange rates and so on, as they are at the moment of establishing our prices. They are therefore no guarantee. Prices will change when costs for tickets, hight of taxes and/or charges change. Since these are costs we cannot control and have to pay forward upon receipt, such changes in price (often raises) will be calculated through into our prices. If we raise our prices on these grounds with more than 15% of the original travel sum, you are entitled to cancel the agreement. We will then be held to repay you the money that is still under our control and for as far we have not entered into any further obligations in the light of the agreement with you. Any money that is refunded to us, will of course be fully paid back to you.

Duration of the journey
The day of departure and the day of return are calculated as a full day in the number of days of the journey. Therefore you are to take into account that your actual stay in the country of destination is at least 2 days shorter than indicated.

Since we are not or only limited dependent on other organizations, we can alter travel dates and durationd of the journeys after consultation with and agreement of all those who have already make a reservation.

We do reserve the right to make changes in travel dates and/or duration, but only in the stadium where the journey has not yet been confirmed as definitive. Those who have made reservations will then acquire only the right to agree with the change(s) or cancel there participation. They will explicitely not acquire any other rights such as a right to indemnification.

Travel dates and/or duration of the journeys that are definitive can only be changes after agreement of the entire group of travel companions, except in those cases where we think there are facts or circumstances (for example climatological circumstances, political circumstances, strike with the airline company, etc., etc., etc.) that make it advisable or necessary to alter the travel dates and/or duration of the journey. This does in no way affect any other mutual obligations.

Responsability and accountability
We accept no responsability or accountability other than to deliver what we offer and then only for as far as the execution of the agreement is within our power and in no case for a larger amount then you have paid us minus the costs of the ticket (including taxes, charges, etc.), except for as far as these costs are repaid by the airline company, and in any case only for as far as you can not claim indemnification with an insurance that has been closed for or by you.

Insurance is your own responsibility. We recommend a travel - and a cancellation insurance. Please take note of the geographic coverage of the insurance policy; it should have world coverage or at least Africa.

A valid passport and visa are your own responsibility, as well as necessary (and sometimes mandatory) vaccinations. If you are denied departure from your country or entry into Kenya because of non-conformity with those and other official requirements, this will be fully on your own account. Any money paid for you (ticket and such) will only be returned for as far as the airline company refunds. From the remainder of the travel sum you will owe us 50% charges or the amount of the actually made expenses and expenses for which we have entered into any engagement and/or costs and/or claims from third parties that occurred from your negligence if these are higher. Any remainder will be returned to you. Should the total amount of the expenses made and obligations entered into and claims and costs of third parties exceeds the amount you paid to us, you are obliged to pay us the excess amount immediately.

It is your own responsibility to consider whether or not you are medically, mentally and physically capable to join our journeys.

Apparent mistakes and mistakes that can be considered to be apparent do not bind us in any way.

Force majeur
We are not responsible for cancellation of a journey or parts of that journey due to force majeur, in the broadest sense of the expression, such as but not limited to stikes with the airline company or airport staff, changes in the political or safety or other situation in Kenya, such wheather conditions that it would be irresponsible to travel, etc.. Such circumstances will give you no other right than reimbursement of (part of) the travel sum and only for as far as the money is still under our power and not obligations are entered into or as far as we can establish reimbursement from the third party such as airline company. Naturally we will do what may reasonably be expected from us to find an alternative or, should the entire trip be cancelled, to try to get your money back.

Substitution
A traveller may have him or herself be replaced by someone else, provided that this other person fulfills any and all obligations from the agreement and personalized documents, such as tickets, can be changed and under full payment of any costs or charges for such changes, furthermore under the condition that other organisations or suppliers involved in the execution of the agreement have no objections.

Legal choice
All our transactions are subject to Dutch law. Any conflicts will be judged by te court of our business address at the time of the appeal.

Nullity
Nullity or partial nullity of any of these conditions does not affect the other conditions or the remainder of the condition in question.
